Accessory Dwelling Unit

 

The City of Novato allows development of an accessory dwelling unit (ADU) on any lot that allows a single-family or multifamily residential use and includes a proposed or existing dwelling. The City also allows the development of a junior accessory dwelling unit (JADU) on any lot developed with a single-family dwelling. The process to build an entirely new unit or to convert a portion of a property into an ADU or JADU can be complex. This webpage is intended to help explain the process.

Accessory Dwelling Unit

An accessory dwelling unit (ADU) is an additional dwelling located on the same lot as a single-family or multifamily development. ADUs have been known by many names: granny flats, in-law units, backyard cottages, secondary units, and more. An ADU must include a kitchen, bathroom, and sleeping area, and must have its own exterior entrance.

There are two categories of ADUs as prescribed by State law: 

Limited Standard ADUs: This is a category of ADUs that are exempt from the City's regulations. That is, the City cannot impose any development standards that are not explicitly prescribed by Government Code Section 66323 for these types of ADUs.

Traditional Standard ADUs: This is a category of ADUs that do not qualify for treatment as limited standard ADUs and can be regulated by locally adopted standards subject to certain limitations and requirements in State law.

Types of ADUs

Detached ADU: Detached ADUs do not share any walls with the primary dwelling and must be separated from the primary dwelling unit.   

Attached ADU: Attached ADUs share wall(s) with the primary dwelling but may not have an internal connection between units. 

Conversion ADU: An ADU conversion is created from existing space in a primary dwelling or accessory building, with small modifications allowed for egress/ingress purposes. A conversion ADU can be located anywhere within the existing building envelope.

Junior Accessory Dwelling Unit: A junior accessory dwelling unit (JADU) is an additional dwelling located entirely within a single-family residence that is limited in size to no more than 500 square feet. A JADU must include permanent provisions for living, sleeping, eating, and cooking.  At a minimum, an efficiency kitchen is required. Bathroom facilities may be independently provided for the JADU or may be shared with occupants of the primary dwelling.  They are typically converted bedrooms in a single-family home that have an entrance into the unit from the main home and an exterior entrance. The owner of the parcel proposed for a JADU must occupy either the primary dwelling unit or the JADU as their principal residence.
