Is my property eligible for an ADU and/or a JADU?

How large of an ADU and/or a JADU am I allowed to build?

The maximum allowable size for an ADU is 1,000 square feet and only when two (2) or more bedrooms are provided. Not all properties can accommodate a unit of this size because applicable development standards (e.g., setbacks, building coverage etc.) would need to be met. Limited standard ADUs, which are permitted pursuant to California Government Code Section 66323, are limited to 800 square feet. The maximum allowable size for a JADU is 500 square feet and is limited to the area of the existing primary dwelling on the parcel – no additions may be permitted to accommodate a JADU.

Do I need to provide parking for an ADU and/or a JADU?

One parking space is required per ADU, unless:

The ADU is located within one-half (½) mile walking distance of public transit.
The ADU is located within an architecturally and historically significant district.
The ADU is created through conversion of existing space (either in the main structure or a detached structure).
On-street parking permits are required but not offered to the occupant of the ADU.
There is a car share vehicle located within one (1) block of the ADU at the time the application is filed with the City.
A permit application for the ADU is submitted at the same time as a permit application for a new single-family or multifamily dwelling on the same lot.

No parking is required for JADUs.

What types of permits are required for an ADU/JADU?

An ADU may be approved with a building permit. Building permit fees are calculated by our Building Division. An ADU that is 750 square feet or larger is subject to Novato’s development impact fee (DIF) which is calculated proportionate to the size of the main home. A JADU is also subject to a building permit review process but is not subject to development impact fees.

Additionally, you should contact the Novato Sanitary District, North Marin Water District, Novato Fire Protection District, and the Novato Public Works Department to determine utility hook-up permit requirements and fees, as well as any additional site-specific requirements that your ADU or JADU must meet (e.g., flood zone, wildland urban interface requirements, etc.).

How long does it take to process a permit for an ADU?

Can I use my ADU for short-term rentals (e.g., AirBnb, Vrbo etc.)?

What if I oppose my neighbor building an ADU or JADU?

Pursuant to California Government Code Sections 66310 to 66342, local jurisdictions are required to consider and ministerially approve applications for ADUs and JADUs if the proposed unit complies with all applicable objective development standards and building code requirements. A local jurisdiction cannot deny an application for an ADU where these standards are met, regardless of neighbor opposition.

As a courtesy, Novato sends a notice to property owners within 100’ radius of property proposed to be developed with an ADU and notices to adjacent neighbors of property proposed to be developed with a JADU.

Can I build a “prefab”, factory-built or “tiny home” ADU? What are the required setbacks for these structures?

Prefab, factory-built, or “tiny homes” are permitted as an ADU, but they must have a permanent foundation and permanent utilities. The method of construction of any proposed ADU shall be reviewed by the Building Department as part of the building permit review process. Prefab structures are subject to the same setbacks and development standards as site-built structures. Mobile homes that were originally intended for highway use are not permitted.
